Welcome to www.jomma.online(hereby referred to as “Jomma”, “Site” or “We”). The following terms and conditions govern your access (including any person or entity you enable/allow access through your access) and use of this application (“App”), the contents contained herein (“Contents”), and the services offered on the App (“Services”).

2. Platform for Communication

You agree, understand and acknowledge that Jomma is an online platform that enables you to connect you to your preferred Brokerage/Asset Management Companies (AMCs) for the purpose of trading in stocks, bonds and mutual funds at the price indicated therein at any time from any location using a payment method of your choice. You further agree and acknowledge that we are only a facilitator and cannot be a party to or control in any manner in any transactions on the Site or on a payment gateway as made available to you by an independent service provider. Accordingly, the contract pertaining to the trading of stocks, bonds and mutual funds on the Site shall be a strictly bipartite contract between you and the Brokerage/AMCs on our Site while the payment processing occurs between you, the payment service provider and in case of prepayments with electronic cards, your issuer bank. Accordingly, the contract of payment on the Site shall be strictly a bipartite contract between you and the payment service provider as listed on our Site.

3. Acceptance of terms

3.1. In order to browse, use and/or access the App and/or the Services you are required to agree to, comply with and be bound by the following terms and conditions. You will be deemed to have accepted these terms and conditions by browsing, viewing, accessing and/or using the App and/or the Services offered on the App.

3.2. If you disagree with any part of these terms and conditions, please do not continue to browse, use and/or access the App and /or the Services.

3.3. Additionally, there may be additional terms and conditions which apply to individual Services which you will be deemed to have accepted if you register for such Services.

3.4. The App may be used by (i) natural persons who have reached 18 years of age and (ii) corporate legal entities, e.g companies.

4. Registration and use of the Services and/or App

4.1. Our Services include allowing users to access price information of market-listed securities (e.g. stocks, bonds) and non-listed mutual funds, assessing different investment options available to users based on their perceived riskiness as widely understood and accepted by market participants, placing buy/sell trade order requests for stocks, bonds and mutual funds with Brokers and AMCs, placing BO account opening request to users’ preferred broker/s, as well as BO account funding and withdrawal requests with Brokers and making online payments through payment gateway service providers for related BO account funding requests and mutual fund purchases, monitoring past financial transaction history and financial performance of users’ holdings of stocks, bonds and mutual funds.

4.2. In order to access/use or continue to access/use the App and/or certain Services, you may be required to provide certain personal information. You agree to provide true, accurate, updated, and complete information when registering at the App or for such Services.

4.3. You agree to access/use the App and/or Services only for purposes that are expressly permitted by (i) these terms and conditions and (ii) any applicable law, regulation, guideline or instruction from Jomma, the industry regulator or any other competent authority or any policy adopted by Jomma with regard to the acceptable access/use of the App and/or Services.

4.4. You agree that you are solely responsible and liable for and that Jomma has no responsibility to you or to any third party for any breach of your obligations under these terms and/or conditions and for the consequences (including any loss or damage which Jomma may suffer) for any such breach.

5. Prohibited use of the App, Services and/or Contents

5.1. You specifically agree not to access/use (or attempt to access/use) any part of the App and/or Services through any form of automated means (including use of scripts or web crawlers) and shall ensure that you comply with, in addition to these terms and conditions, instructions set out in relation to the access/use of any part of the App and/or Services.

5.2. You agree that you will not engage in any form of activity that interferes with or disrupts any part of the App and/or Services (or the servers and networks which are connected to the App and/or Services).

5.3. You agree that you will not reproduce, duplicate, copy, sell, trade or resell any part of the App and/or Services for any purpose.

5.4. You, and any person or entity you allow to access/use the App and/or Services through your internet access/access to the App and/or Services, are not allowed to:

5.4.1. Copy, disclose, modify, reformat, display, distribute, licence, transmit, sell, perform, publish, transfer, link to, reverse engineer or decompile or otherwise make available any part of the App and/or Services except as set out in these terms and conditions;

5.4.2. Include or create links (including deep links) to or from the App and/or Services;

5.4.3. Replicate the App and/or Services or create a separate border around any part of the App and/or Services (also known as framing);

5.4.4. Use the App and/or Services for storing, reproducing, transmitting, communicating or receiving any Offending Material. For the purpose of these terms and conditions, Offending Material means any content transmitted using the App and/or Services that is:

5.4.4.1. In breach of any law, regulation, guideline or instruction invoked by Jomma, industry regulator or any other competent authority or any policy adopted by Jomma with regard to the acceptable access/use of the App and/or Services, or

5.4.4.2. Abusive, indecent, defamatory, obscene, pornographic, offensive or menacing or that has the effect (as may be contemplated by a reasonable person) of causing the recipient to feel so harassed, abused or offended; or

5.4.4.3. Designed to cause annoyance, inconvenience or needless anxiety to any person or entity; or

5.4.4.4. In breach of confidence, intellectual property rights, privacy or any right of a third party.

5.4.5. Hack into, make excessive traffic demands, probe or port scan other computers, deliver viruses, mail bombs, chain letters or pyramid schemes or otherwise engage in any other behaviour intended to inhibit other users from accessing/using any part of the App and/or Services or any other App or services;

5.4.6. Collect and process others' personal data, except in accordance with applicable data protection law and these terms and conditions;

5.4.7. Advertise or offer to sell goods or services on the pretext that the same are endorsed, offered for sale or originate from Jomma;

5.4.8. Infringe any other person's or entity’s intellectual property rights;

5.4.9. Use the App and/or Services to harvest or collect information about users of the App and/or Services or to post or otherwise distribute unauthorised or unsolicited advertising, junk or bulk email (also known as "spam");

5.4.10. Use any part of the App and/or Services in any way that we in our sole and absolute discretion consider objectionable, inappropriate, likely to injure our business, brand, goodwill, reputation or otherwise unacceptable;

5.4.11. Use the App and/or Services to send emails and other content coached, phrased or written in such a manner as to give an impression that the email is correspondence from Jomma.

5.4.12. You are responsible for any misuse of the App and/or Services even if it is by another person or entity using your access to the App and/or Services.

5.5. We reserve the right to block, remove, edit or refuse to post any material that you attempt to transmit through the App and/or Services that we deem to be in contravention of these terms and conditions and to take such other action as we in our sole and absolute discretion consider necessary to prevent or remedy any breach of these terms and/or conditions. If you become aware of any content or material circulated using the App and/or Services that is in breach of these terms and/or conditions, Contents or materials on the App and/or Services then we encourage you to promptly inform us by contacting our customer care centre at help@jomma.online. We are not responsible or liable for any failure to remove, block, edit or delay in removing, etc. any such infringing content or material or third party material from the App and/or Services or for any good faith but wrongful removal of third party material.

6. The information we may collect

6.1. We may collect, inter alia, the following information from you:

6.1.1. Full Name;

6.1.2. Shop/Business/Institute Name;

6.1.3. Business/Institute Type;

6.1.4. Home/Shop/Business Address including District & Thana (Police Station);

6.1.5. Contact Information including Mobile Number, E-mail Address;

6.1.6. Nominee Information including Nominee NID, name, picture and relationship with user;

6.1.7. Financial account information including Bank/Financial Institution account name, number, branch information;

6.1.8. Demographic and Personal Information such as identification number (e.g. NID/Passport/Driver’s License Number/eTIN), Nationality, Postcode, Preferences and Interests; and

6.1.9. Other Information relevant to Registration, Surveys, User Onboarding by licensed financial service providers and/or Offers.

6.2. If you do not wish to register, we may not collect any personal information from you and you may visit our App anonymously. However, you will be bound by these terms and conditions with regard to access/use of this App and/or Services.

7.1. Jomma may hold and use the information provided by you for a number of purposes, which may include:

7.1.1. Sharing information with Jomma-affiliated financial institutions such as Brokers, AMCs and others for the purposes of such financial institutions to fulfill their legal and regulatory obligations in providing financial services through Jomma, such as but not limited to Know Your Customer (KYC), customer due diligence and user onboarding requirements.

7.1.2. Carrying out any activity in connection with a legal, governmental or regulatory requirement on Jomma in connection with existing or prospective legal proceedings or in respect of any crime or fraud prevention, detection or prosecution.

7.1.3. Monitoring and/or recording of your communications for Jomma’s business purposes such as marketing, quality control and training, prevention of unauthorised use of Jomma’s technical systems, and ensuring effective systems operation in order to prevent, detect or prosecute any crime or fraud.

7.1.4. Share such information with third parties for Jomma’s business purposes such as marketing, quality control and training, acquisition of customers, agents, and/or merchants, customer services, etc.

7.2. In addition to the above, any information we may collect from you may be used, inter alia, for the following purposes:

7.2.1. To provide Jomma Services;

7.2.2. For internal record keeping;

7.2.3. To improve the App (we continually strive to improve our App based on the information and feedback received from you);

7.2.4. To send periodic emails;

7.2.5. To administer a contest, promotion, survey or other App feature.

7.3. Jomma may access your financial information – such as, but not limited to, BO account balance, value and number of shares/bonds/mutual fund units held, gain/loss of financial securities held – from Jomma-affiliated Brokers/AMCs and other financial service providers for the purposes of validating your future trade requests on a real-time basis as well as calculating and displaying relevant analytical information to you.

7.4. We implement a variety of security measures to maintain safety to hold and store your personal information. However, neither we nor any third parties provide any warranty or guarantee as to the security and safety measures related to the storage of your personal information.

8. Intellectual Property Rights

8.1. All copyright, trademarks, patents, brand names, corporate names and other intellectual property rights in any material or content (including without limitation software, data, applications, information, text, photographs, music, sound, videos, graphics, logos, symbols, artwork, designs, layout, look, appearance and other material or moving images) contained in or accessible via the Services is either owned by Jomma or has been licensed to Jomma by the rights’ owner(s) for use as part of the Services and/or on the App. The Jomma name and logo are registered trademarks of Jomma. All trademarks reproduced herein, which are not the property of or licensed to Jomma, are the property of their respective owners.

8.2. You are only allowed to access/use the App and/or Services as set out in these terms and conditions. If you wish to access/use the Contents or any part thereof for any other purpose other than reviewing it on the App then you will be required to obtain the prior written permission of the owner of the rights in that material. All rights are expressly reserved.

8.3. Having noted the above you shall not be entitled in respect of any Contents (wholly or partly):

8.3.1. To reproduce, duplicate, copy, sell, trade or resell any part of the Contents for any purpose; or

8.3.2. To pass any part of the Contents on to third parties or to allow third parties to access/use any part thereof for any purpose in any way unless and to the extent expressly permitted; or

8.3.3. To change, edit, modify, reformat or adapt any part of the Contents in any way.

8.4. Any unauthorized access/use of this App, Services and/or Contents may give rise to a claim for damages, penalty, losses, legal suit and/or amount to a criminal offense. Further, you will also be liable for all costs and consequences arising out of any claim, demand, penalty, proceeding or legal suit (civil or criminal) initiated as a result of your unauthorized access/use of this App, Services and/or Contents.

8.5. Any unauthorized use, reproduction or alteration of the Jomma name, logo, and/or any components of the same are strictly prohibited and Jomma will utilize all resources to claim, demand, bring legal proceedings against such unauthorized use, reproduction or alteration and extend all out efforts to penalize, prosecute and seek compensation, damages, losses and costs from such persons or entities.

9. No Warranties

9.1. Any information or materials provided herein is solely for your personal information and convenience, and is not intended for any commercial use nor shall be relied upon for making your investment decisions and therefore the same shall not be treated as a representation or offer of any kind. Such information or materials are not appropriate for the purposes of making a decision to carry out a transaction or trade, nor does it provide any form of advice (investment, tax, legal) amounting to investment advice, or make any recommendations regarding particular financial instruments, investments, products or services.

9.2. The information contained in this App, Services and/or Contents may be out of date and/or may contain other errors or omissions. Jomma provides the Services and Contents on the App "as is" and makes no warranties of any kind, either express or implied, with respect to the Services and/or the Contents (including without limitation regarding their satisfactory quality, freedom from viruses or other harmful components, fitness for a particular purpose, suitability, reliability, timeliness, accuracy, completeness, security or that they are free from error).

9.3. Neither Jomma nor any third party provides any warranty or guarantee or assumes any liability or responsibility as to the accuracy, timeliness, performance, completeness, suitability or otherwise of the information or materials (including but not limited to Contents, Services, activities or offers) found, offered or represented on this App for any particular purpose. You acknowledge that such information, materials, Contents, Services, activities or offers may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

9.4. Jomma reserves the right to replace or amend the features, facilities and charges, and the information and materials pertaining to such features, facilities and charges, in relation to the Services, Contents, App and Jomma Services at any time. All Jomma Services offered are subject to the standard Terms and Conditions for Jomma Services.

10. Third-Party Hyperlinks and Apps

10.1. From time to time, this App may also include links to other Apps. These links are provided for your convenience and to provide further information only.

10.2. The inclusion of such links to third party Apps not controlled by us does not imply any endorsement by us of such Apps and as such any transaction you may make with any third party flowing from such links is carried out entirely at your own risk and we accept no liability for any damages or losses that you may suffer as a result.

10.3. These third-party Apps have separate and independent terms and conditions and privacy policies for their access/use. Neither we nor any third parties provide any warranty or guarantee or assume any liability or responsibility as to the accuracy, timeliness, performance, completeness, suitability or otherwise of the information or materials (including but not limited to contents, services, activities or offers) found, offered or represented on the linked App(s) for any particular purpose. You acknowledge that such information or materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Jomma explicitly disclaims any responsibility or liability as to any consequential losses or damages arising as a consequence of any of the above.

11. Use of Cookies

We use cookies at or in our App for identifying users during navigation of the App during an internet session and identifying returning Jomma users. However, we do not take any responsibility for any third-party Apps whose links have been included in our App as to whether such Apps use cookies or not.

12. Liability

12.1. Jomma will serve its customers with the accurate set of personal finance and investment related data and information on the best effort-basis. However, Jomma will source most of this data and information from dependent third parties- hence there can be data-quality issues. In such an unlikely situation, Jomma will not be responsible for subsequent consequences, if any.

12.2. You acknowledge and undertake that you are accessing the Services on the Site and transacting at your own risk and are using your best and prudent judgment before entering into any transactions through the Site. We shall neither be liable nor responsible for any actions or inactions of the Brokerages/AMCs nor any breach of conditions, representations or warranties by the Brokerage/AMCs and hereby expressly disclaim all responsibility and liability in that regard. We shall not mediate or resolve any dispute or disagreement between you and the concerned Brokerage/AMCs. We shall neither be liable or responsible for any actions or inactions of any other service provider as listed on our Site which includes but is not limited to payment service providers, etc.

12.3. Jomma cannot be responsible if Jomma users either knowingly or unknowingly share their login information, such as username and password.

12.4. Jomma cannot be held responsible for accuracy of price information published by Brokers/AMCs. Furthermore, price information, especially of listed shares, will be dynamic and subject to constant change during market trading hours.

12.5. Jomma cannot bear any responsibility/legal liability for how Jomma-affiliated institutions/partners use the information made available to them by Jomma following user consent.

12.6. Jomma shall not be liable for any loss of use, access, profits or data or any direct, indirect, special or consequential damages or losses, whether such losses or damages arise in contract, negligence, tort or otherwise including without limitation to the foregoing any damages or losses in relation to:

12.6.1. Your use of, reliance upon or inability to use the App, Services and/or Contents;

12.6.2. If you are dissatisfied or you do not agree with any part of the App, Services, Contents and/or any of these terms and conditions, your sole and exclusive remedy is to discontinue your use/access of this App, Services and/or Contents.

13. Indemnity by You

13.1. You irrevocably agree to indemnify Jomma and any of our third-party providers (hereinafter collectively referred to as the “ Indemnified Parties”) fully against and to hold the Indemnified Parties harmless on demand from all losses, damages, demands, claims, proceedings, suits, costs and expenses (including reasonable legal costs and expenses) and liabilities howsoever incurred by the Indemnified Parties as a result of any claims, demands, proceedings or suits by a third party resulting from your use/access of the App, Services and/or Contents in breach or non-observance of these terms and conditions.

13.2. We shall notify you of any such claims, demands, proceedings or suits that we or any of the other Indemnified Parties receive and you hereby agree to provide us and/or any of the Indemnified Parties with full authority to defend or settle such claims, demands, proceedings or suits and shall provide us and/or any of the Indemnified Parties with all reasonable assistance necessary to defend or settle such claims, demands, proceedings or suits at your sole cost and expense.

14. General

14.1. The information and materials provided in relation to the Contents and Services on the pages of this App are for your general information and use/access only and any part of such information and materials is subject to change without notice at our sole discretion.

14.2. Jomma reserves the right to review, revise, amend and/or change the Services, Contents, App, its policies and/or these terms and conditions at any time without any prior notice and you will be deemed to have been bound by such revision, amendment or change by continuing to use/access the App, Services and/or Contents.

14.3. The construction, validity and performance of these terms and conditions shall be governed in all respects by the prevailing laws of Bangladesh. Your use/access of this App and any dispute arising out of such use/access of the App is also subject to the prevailing laws of Bangladesh.

14.4. If any part of the provisions of these terms and conditions are declared by any judicial or other competent authority to be void, voidable, illegal or otherwise unenforceable, such a term shall be amended or at the discretion of Jomma it may be severed from these terms and conditions and the remaining part of the affected provision and other remaining provisions of these terms and conditions shall remain in full force and effect.

14.5. Except where these terms and conditions provide otherwise, the rights and remedies contained herein are cumulative and not exclusive to rights and remedies provided by law. The failure by Jomma to enforce at any time or for any period any one or more of the terms and conditions shall not be a waiver of them or of the right at any time subsequently to enforce all terms and conditions.

14.6. Jomma shall not be held responsible for any delay or failure to comply with any of its obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

14.7. You shall not assign these terms and conditions to a third party. Jomma may assign these terms and conditions in whole or part to any third party at its discretion.

14.8. You acknowledge that in agreeing to these terms and conditions you do not rely on, shall have no remedy in respect of, any statement, representation, warranty, guarantee or understanding (whether negligently or innocently made) of any person (whether a party to these terms and conditions or not) other than as expressly set out in these terms and conditions as a warranty.

14.9. In the event that we decide to permanently withdraw the Services, Contents and/or the App, Jomma shall not be liable to you for any ensuing loss or damage occasioned to you from such a suspension, change or termination. Termination shall however not affect your accrued liabilities towards us.

15. Privacy Policy

15.1. At Jomma, we are bly committed to protecting the personal and financial information that you submit to us. This information is provided when you register to receive certain services or products, such as online share trading. The personal information we get from you will help us provide you with improved services and products that match your needs as closely as possible.

15.2. We, at Jomma, acknowledge and accept that the personal details that you impart to us, is to be kept in strict confidentiality and to use the information only in the manner which would be beneficial to our customers. We consider our relationship with you as invaluable and strive to respect and safeguard your right to privacy. We shall protect the personal details received from you with the same degree of care, but no less than a reasonable degree of care, to prevent the unauthorized use, dissemination, or publication of this information as we protect our own confidential information of a like nature. We shall use the personal information to improve our service to you and to keep you updated about our new product or information that may be of interest to you. The information collected from you would be used in the right spirit and context in which it is intended to be used.

15.3. Jomma will strictly maintain confidentiality of customer’s personal information and financial data. No such personal information and financial data will be shared with any external parties without explicit consent taken from the respective customer. Management officials access to customer data will be limited to the extent needed for servicing customer’s designated problem/ request.

15.4. No personal documents such as photo, NID or TIN etc. of Jomma’s customers will be shared with any unauthorized external party. Such documents will be shared only if such is necessary for the work assigned to Jomma by its customer.

16. Non-discrimination Policies

Jomma and its affiliates prohibit discrimination against users based on race, religion, national origin, disability, sex, marital status, gender identity, age or any other characteristic protected under applicable law.

17. Governing Law

The terms and conditions shall be construed in accordance with the laws of the Peoples’ Republic of Bangladesh. You agree that the courts, tribunals and/or quasi-judicial bodies located in Dhaka, Bangladesh shall have the exclusive jurisdiction on any dispute arising inside Bangladesh under this Agreement.

18. Availability of Web-Site & Data in Transit

We do not warrant that the Site will be available at all times and that access will not be interrupted, failures, errors or omissions or loss of information during transmission. We also do not warrant that no viruses or other contaminating data will be transmitted or that no damage will take place to your computer system. You shall be solely responsible for adequate protection and back up of your system and data. We make no representations or warranties regarding the functionality or performance of any third party software that may be used in connection with the Site.

3. শর্তাবলী গ্রহণ

3.1. অ্যাপ এবং/অথবা পরিষেবাগুলি ব্রাউজ করতে, ব্যবহার করতে এবং/অথবা অ্যাক্সেস করতে আপনাকে সম্মত হতে হবে, মেনে চলতে হবে এবং নিম্নলিখিত নিয়ম ও শর্তাবলী দ্বারা আবদ্ধ হতে হবে। আপনি ব্রাউজিং, দেখা, অ্যাক্সেস এবং/অথবা অ্যাপ এবং/অথবা অ্যাপে দেওয়া পরিষেবাগুলি ব্যবহার করে এই শর্তাবলী স্বীকার করেছেন বলে মনে করা হবে।

3.2. আপনি যদি এই শর্তাবলীর কোনো অংশের সাথে একমত না হন তবে অনুগ্রহ করে অ্যাপ এবং/অথবা পরিষেবাগুলি ব্রাউজ, ব্যবহার এবং/অথবা অ্যাক্সেস করা চালিয়ে যাবেন না।

3.3. অতিরিক্তভাবে, এমন অতিরিক্ত শর্তাবলী থাকতে পারে যা পৃথক পরিষেবার ক্ষেত্রে প্রযোজ্য যা আপনি যদি এই ধরনের পরিষেবাগুলির জন্য নিবন্ধন করেন তবে আপনি গ্রহণ করেছেন বলে মনে করা হবে৷

3.4. অ্যাপটি ব্যবহার করা যেতে পারে (i) স্বাভাবিক ব্যক্তিরা যারা ১৮ বছর বয়সে পৌঁছেছেন এবং (ii) কর্পোরেট আইনি সত্ত্বা, যেমন কোম্পানিগুলো।

4. পরিষেবা এবং/অথবা অ্যাপের নিবন্ধন এবং ব্যবহার

4.1. আমাদের পরিষেবাগুলির মধ্যে রয়েছে ব্যবহারকারীদের বাজার-তালিকাভুক্ত সিকিউরিটিজ (যেমন স্টক, বন্ড) এবং অ-তালিকাভুক্ত মিউচুয়াল ফান্ডের মূল্যের তথ্য অ্যাক্সেস করার অনুমতি দেওয়া, ব্যবহারকারীদের জন্য উপলব্ধ বিভিন্ন বিনিয়োগের বিকল্পগুলি মূল্যায়ন করা তাদের অনুভূত ঝুঁকির উপর ভিত্তি করে যা বাজারের অংশগ্রহণকারীদের দ্বারা ব্যাপকভাবে বোঝা এবং গৃহীত হয়েছে, ক্রয় করা /ব্রোকার এবং এএমসি এর সাথে স্টক, বন্ড এবং মিউচুয়াল ফান্ডের জন্য ট্রেড অর্ডারের অনুরোধ বিক্রি করা, ব্যবহারকারীদের পছন্দের ব্রোকার/দের কাছে BO অ্যাকাউন্ট খোলার অনুরোধ রাখা, সেই সাথে ব্রোকারদের সাথে BO অ্যাকাউন্ট ফান্ডিং এবং উত্তোলনের অনুরোধ করা এবং পেমেন্ট গেটওয়ে পরিষেবা প্রদানকারীদের মাধ্যমে অনলাইন পেমেন্ট করা সম্পর্কিত BO অ্যাকাউন্ট তহবিল অনুরোধ এবং মিউচুয়াল ফান্ড ক্রয়ের জন্য, অতীতের আর্থিক লেনদেনের ইতিহাস এবং স্টক, বন্ড এবং মিউচুয়াল ফান্ডের ব্যবহারকারীদের হোল্ডিংয়ের আর্থিক কার্যকারিতা নিরীক্ষণ।

4.2. অ্যাপ এবং/অথবা নির্দিষ্ট কিছু পরিষেবা অ্যাক্সেস/ব্যবহার করতে বা অ্যাক্সেস/ব্যবহার চালিয়ে যেতে, আপনাকে কিছু ব্যক্তিগত তথ্য প্রদান করতে হতে পারে। অ্যাপে বা এই ধরনের পরিষেবার জন্য নিবন্ধন করার সময় আপনি সত্য, নির্ভুল, আপডেটেড এবং সম্পূর্ণ তথ্য প্রদান করতে সম্মত হন।

4.3. অ্যাপ এবং/অথবা পরিষেবাগুলির গ্রহণযোগ্য অ্যাক্সেস/ব্যবহার সংক্রান্ত ক্ষেত্রে আপনি শুধুমাত্র (i) এই নিয়ম ও শর্তাবলী এবং (ii) Jomma, শিল্প নিয়ন্ত্রক বা অন্য কোন উপযুক্ত কর্তৃপক্ষ প্রযোজ্য আইন, প্রবিধান, নির্দেশিকা বা Jomma দ্বারা গৃহীত কোন নীতি বা নির্দেশ দ্বারা স্পষ্টভাবে অনুমোদিত উদ্দেশ্যে অ্যাপ এবং/অথবা পরিষেবাগুলি অ্যাক্সেস/ব্যবহার করতে সম্মত হন। ।

4.4. আপনি সম্মত হন যে আপনি সম্পূর্ণরূপে দায়ী এবং দায়বদ্ধ এবং এই শর্তাবলী এবং/অথবা শর্তাবলীর অধীনে আপনার বাধ্যবাধকতা লঙ্ঘনের জন্য এবং ফলাফলের জন্য (যেকোন ক্ষতি বা ক্ষতি সহ যা Jomma-এর ভোগে ) এই ধরনের কোনো লঙ্ঘনের জন্য।

5. অ্যাপ, পরিষেবা এবং/অথবা বিষয়বস্তুর ব্যবহার নিষিদ্ধ

5.1. আপনি বিশেষভাবে স্বয়ংক্রিয় উপায়ে (স্ক্রিপ্ট বা ওয়েব ক্রলার ব্যবহার এর মাধ্যমে) অ্যাপ এবং/অথবা পরিষেবাগুলির কোন অংশ অ্যাক্সেস/ব্যবহার (বা অ্যাক্সেস/ব্যবহার করার চেষ্টা) না করার বিষয়ে সম্মত হন এবং এর সাথে আপনি মেনে চলেন তা নিশ্চিত করবেন এই নিয়ম ও শর্তাবলীতে, অ্যাপ এবং/অথবা পরিষেবাগুলির যেকোনো অংশের অ্যাক্সেস/ব্যবহারের ক্ষেত্রে নির্দেশাবলী সেট করা হয়েছে।

5.2. আপনি সম্মত হন যে আপনি এমন কোনও কার্যকলাপে জড়িত হবেন না যা অ্যাপ এবং/অথবা পরিষেবাগুলির (অথবা অ্যাপ এবং/অথবা পরিষেবাগুলির সাথে সংযুক্ত সার্ভার এবং নেটওয়ার্কগুলির) কোন অংশে হস্তক্ষেপ করে বা ব্যাহত করে।

5.3. আপনি সম্মত হন যে আপনি কোন উদ্দেশ্যে অ্যাপ এবং/অথবা পরিষেবাগুলির কোন অংশ পুনরুত্পাদন, নকল, অনুলিপি, বিক্রয়, বাণিজ্য বা পুনঃবিক্রয় করবেন না।

5.4. আপনি, এবং যেকোন ব্যক্তি বা সত্তাকে আপনি আপনার ইন্টারনেট অ্যাক্সেস/অ্যাপ এবং/অথবা পরিষেবাগুলিতে অ্যাক্সেসের মাধ্যমে অ্যাপ এবং/অথবা পরিষেবাগুলি অ্যাক্সেস/ব্যবহার করার অনুমতি দেন, এর অনুমতি নেই:

5.4.1. অনুলিপি, প্রকাশ, সংশোধন, পুনর্বিন্যাস, প্রদর্শন, বিতরণ, লাইসেন্স, প্রেরণ, বিক্রয়, সম্পাদন, প্রকাশ, স্থানান্তর, লিঙ্ক, রিভার্স ইঞ্জিনিয়ার বা ডিকম্পাইল বা অন্যথায় অ্যাপ এবং/অথবা পরিষেবাগুলির যে কোন অংশ উপলব্ধ করা যা শর্তাবলীর বাইরের;

5.4.2. অ্যাপ এবং/অথবা পরিষেবাগুলিতে বা থেকে লিঙ্কগুলি (গভীর লিঙ্ক সহ) অন্তর্ভুক্ত বা তৈরি;

5.4.3. অ্যাপ এবং/অথবা পরিষেবাগুলির প্রতিলিপি তৈরি বা অ্যাপ এবং/অথবা পরিষেবাগুলির যে কোনও অংশের চারপাশে একটি পৃথক সীমানা তৈরি (যা ফ্রেমিং নামেও পরিচিত);

5.4.4. কোনো আপত্তিকর উপাদান সংরক্ষণ, পুনরুত্পাদন, প্রেরণ, যোগাযোগ বা গ্রহণের জন্য অ্যাপ এবং/অথবা পরিষেবাগুলি ব্যবহার৷ এই শর্তাবলীর জন্য উল্লেখ্য, আপত্তিকর উপাদান মানে অ্যাপ এবং/অথবা পরিষেবাগুলি ব্যবহার করে প্রেরিত কোনও কন্টেন্ট যা হল:

5.4.4.1. Jomma, শিল্প নিয়ন্ত্রক বা অন্য কোন উপযুক্ত কর্তৃপক্ষের দ্বারা আরোপিত কোনও আইন, প্রবিধান, নির্দেশিকা বা নির্দেশ লঙ্ঘন করে বা অ্যাপ এবং/অথবা পরিষেবাগুলির গ্রহণযোগ্য অ্যাক্সেস/ব্যবহারের বিষয়ে Jomma দ্বারা গৃহীত কোন নীতি বা

5.4.4.2. অপমানজনক, অশ্লীল, মানহানিকর, অশ্লীল, আপত্তিকর বা ভীতিকর বা যার প্রভাব রয়েছে (যেমন একজন যুক্তিযুক্ত ব্যক্তির দ্বারা বিবেচনা করা যেতে পারে) যার ফলে প্রাপককে এতটা হয়রানি, অপব্যবহার বা বিক্ষুব্ধ বোধ করা হয়; বা

5.4.4.3. কোনো ব্যক্তি বা সত্তাকে বিরক্তি, অসুবিধা বা অপ্রয়োজনীয় উদ্বেগ সৃষ্টি করার জন্য ডিজাইন করা হয়েছে; বা

5.4.4.4. আস্থা লঙ্ঘন, মেধা সম্পত্তি অধিকার, গোপনীয়তা বা তৃতীয় পক্ষের কোনো অধিকার লঙ্ঘন।

5.4.5. হ্যাকিং, অত্যধিক ট্র্যাফিক দাবি করা, অন্যান্য কম্পিউটারের অনুসন্ধান বা পোর্ট স্ক্যান করা, ভাইরাস, মেইল বোমা, চেইন লেটার বা পিরামিড স্কিম সরবরাহ করা বা অন্য যেকোনো উপায়ে অন্য ব্যবহারকারীদের অ্যাপের যেকোনো অংশএবং/অথবা পরিষেবা বা অন্য কোন অ্যাপ বা পরিষেবা অ্যাক্সেস/ব্যবহার করতে বাধা দেওয়ার উদ্দেশ্যে অন্য কোনো আচরণে জড়িত হওয়া;

5.4.6. প্রযোজ্য ডেটা সুরক্ষা আইন এবং এই শর্তাবলীর বাইরের ব্যতীত অন্যদের ব্যক্তিগত ডেটা সংগ্রহ এবং প্রক্রিয়া করা ;

5.4.7. এই অজুহাতে পণ্য বা পরিষেবা বিক্রির বিজ্ঞাপন বা অফার করা যেন তা অনুমোদন করা হয়েছে, বিক্রয়ের জন্য দেওয়া হয়েছে বা Jomma থেকে উদ্ভূত হয়েছে;

5.4.8. অন্য কোনো ব্যক্তি বা সত্তার মেধা সম্পত্তি অধিকার লঙ্ঘন;

5.4.9. অ্যাপ এবং/অথবা পরিষেবাগুলি ব্যবহার করে অ্যাপ এবং/অথবা পরিষেবাগুলোর ব্যবহারকারীদের সম্পর্কে তথ্য সংগ্রহ বা সংগ্রহ করতে বা অননুমোদিত বা অযাচিত বিজ্ঞাপন, জাঙ্ক বা বাল্ক ইমেইল পোস্ট বা বিতরণ করা (এটি স্প্যাম নামেও পরিচিত ) ;;

5.4.10. অ্যাপ এবং/অথবা পরিষেবাগুলির যে কোনো অংশ এমন কোনও উপায়ে ব্যবহার করা যা আমরা আমাদের একক এবং সম্পূর্ণ বিবেচনার ভিত্তিতে আপত্তিকর, অনুপযুক্ত, আমাদের ব্যবসা, ব্র্যান্ড, গুডউইল, খ্যাতি বা অন্যথায় অগ্রহণযোগ্য বলে মনে করি;

5.4.11. অ্যাপ এবং/অথবা পরিষেবাগুলি ব্যবহার করে ইমেইল এবং অন্যান্য বিষয়বস্তু প্রশিক্ষিত, বাক্যাংশ বা লেখা এমনভাবে পাঠান যাতে ধারণা দেওয়া যায় যে ইমেইলটি Jomma-এর চিঠিপত্র।

5.4.12. অ্যাপ এবং/অথবা পরিষেবাগুলির কোন অপব্যবহারের জন্য আপনি দায়ী, এমনকি যদি এটি অন্য কোনও ব্যক্তি বা সত্তা অ্যাপ এবং/অথবা পরিষেবাগুলিতে আপনার অ্যাক্সেস ব্যবহার করে থাকে।

5.5. আপনি অ্যাপ এবং/অথবা পরিষেবাগুলির মাধ্যমে প্রেরণ করার চেষ্টা করেন এমন কোন উপাদানকে ব্লক করার, অপসারণ করা, সম্পাদনা করা বা পোস্ট করতে অস্বীকার করার অধিকার আমরা সংরক্ষণ করি যা আমরা এই নিয়ম ও শর্তাবলী লঙ্ঘন বলে মনে করি এবং অন্যান্য পদক্ষেপ নেওয়া যা এই শর্তাবলী এবং/অথবা শর্তগুলো কোনো লঙ্ঘন প্রতিরোধ বা প্রতিকার করার জন্য একমাত্র এবং পরম বিচক্ষণতার প্রয়োজন বলে মনে করি। আপনি যদি অ্যাপ এবং/অথবা পরিষেবাগুলি ব্যবহার করে প্রচারিত কোনও বিষয়বস্তু বা উপাদান সম্পর্কে সচেতন হন যা এই শর্তাবলী এবং/অথবা অ্যাপ এবং/অথবা পরিষেবাগুলির বিষয়বস্তু বা সামগ্রী লঙ্ঘন করে তবে আমরা আপনাকে আমাদের সাথে যোগাযোগ করে অবিলম্বে আমাদের জানাতে উৎসাহিত করবো support@jomma.online এ কাস্টমার কেয়ার সেন্টার। আমরা থার্ড পার্টি ম্যাটেরিয়াল অপসারণ, ব্লক, সম্পাদনা বা অপসারণ বিলম্ব, ইত্যাদি অপসারণ করতে কোনো ব্যর্থতার জন্য দায়ী বা দায়বদ্ধ নই

6. তথ্য আমরা সংগ্রহ করতে পারে

6.1. আমরা আপনার কাছ থেকে নিম্নলিখিত তথ্য সংগ্রহ করতে পারি:

6.1.1. পুরো নাম;

6.1.2. দোকান/ব্যবসা/ইনস্টিটিউটের নাম;

6.1.3. ব্যবসা/ইনস্টিটিউট এর ধরন;

6.1.4. বাড়ি/দোকান/ব্যবসায়িক ঠিকানা সহ জেলা ও থানা (পুলিশ স্টেশন);

6.1.5. মোবাইল নম্বর, ই-মেইল ঠিকানা সহ যোগাযোগের তথ্য;

6.1.6. নমিনি NID, নাম, ছবি এবং ব্যবহারকারীর সাথে সম্পর্ক সহ নমিনি তথ্য;

6.1.7. ব্যাংক/আর্থিক প্রতিষ্ঠানের অ্যাকাউন্টের নাম, নম্বর, শাখার তথ্য সহ আর্থিক অ্যাকাউন্টের তথ্য;

6.1.8. ডেমোগ্রাফিক এবং ব্যক্তিগত তথ্য যেমন শনাক্তকরণ নম্বর (যেমন NID/পাসপোর্ট/ড্রাইভিং লাইসেন্স নম্বর/eTIN), জাতীয়তা, পোস্ট কোড, পছন্দ এবং আগ্রহ; এবং

6.1.9. লাইসেন্সপ্রাপ্ত আর্থিক পরিষেবা প্রদানকারী এবং/অথবা অফার দ্বারা নিবন্ধন, সমীক্ষা, ব্যবহারকারী অনবোর্ডিং সম্পর্কিত অন্যান্য তথ্য।

6.2. আপনি যদি নিবন্ধন করতে না চান তবে আমরা আপনার কাছ থেকে কোনো ব্যক্তিগত তথ্য সংগ্রহ করতে পারি না এবং আপনি বেনামে আমাদের অ্যাপটি দেখতে পারেন। যাইহোক, আপনি এই অ্যাপ এবং/অথবা পরিষেবাগুলির অ্যাক্সেস/ব্যবহারের ক্ষেত্রে এই শর্তাবলী দ্বারা আবদ্ধ হবেন।

7. আপনার তথ্য ব্যবহার

7.1. Jomma আপনার দেওয়া তথ্য ধারণ করতে পারে এবং ব্যবহার করতে পারে বিভিন্ন উদ্দেশ্যে, যার মধ্যে অন্তর্ভুক্ত থাকতে পারে:

7.1.1. Jomma-এর মাধ্যমে আর্থিক পরিষেবা প্রদানের ক্ষেত্রে Jomma-অধিভুক্ত আর্থিক প্রতিষ্ঠান যেমন ব্রোকার, এএমসি এবং অন্যদের সাথে তাদের আইনি ও নিয়ন্ত্রক বাধ্যবাধকতা পূরণ করার জন্য এই ধরনের আর্থিক প্রতিষ্ঠানের উদ্দেশ্যে তথ্য শেয়ার করা, যেমন আপনার কেওয়াইসি, গ্রাহকের ডিউ ডিলিজেন্স এবং গ্রাহকের অনবোর্ডিং রিকোয়ারমেন্টস।

7.1.2. বিদ্যমান বা সম্ভাব্য আইনি কার্যক্রমের সাথে বা কোন অপরাধ বা জালিয়াতি প্রতিরোধ, সনাক্তকরণ বা বিচারের ক্ষেত্রে Jomma-এর উপর একটি আইনি, সরকারী বা নিয়ন্ত্রক প্রয়োজনীয়তার সাথে সম্পর্কিত যেকোনো কার্যকলাপ পরিচালনা করা।

7.1.3. Jomma-এর ব্যবসায়িক উদ্দেশ্যে যেমন বিপণন, গুণমান নিয়ন্ত্রণ এবং প্রশিক্ষণ, Jomma-এর প্রযুক্তিগত সিস্টেম অননুমোদিত ব্যবহার প্রতিরোধ এবং কোন অপরাধ বা জালিয়াতি প্রতিরোধ, সনাক্ত বা বিচার করার জন্য কার্যকর সিস্টেম অপারেশন নিশ্চিত করার জন্য আপনার যোগাযোগের পর্যবেক্ষণ এবং/অথবা রেকর্ডিং।

7.1.4. Jomma-এর ব্যবসায়িক উদ্দেশ্যে যেমন মার্কেটিং, মান নিয়ন্ত্রণ এবং প্রশিক্ষণ, গ্রাহক, এজেন্ট এবং/অথবা বণিকদের অধিগ্রহণ, গ্রাহক পরিষেবা ইত্যাদির জন্য এই ধরনের তথ্য তৃতীয় পক্ষের সাথে শেয়ার করা।

7.2. উপরোক্ত ছাড়াও, আমরা আপনার কাছ থেকে সংগ্রহ করতে পারি এমন যেকোন তথ্য নিম্নলিখিত উদ্দেশ্যে ব্যবহার করা যেতে পারে:

7.2.1. Jomma সেবা প্রদান;

7.2.2. অভ্যন্তরীণ রেকর্ড রাখার জন্য;

7.2.3. অ্যাপটি উন্নত করতে (আমরা আপনার কাছ থেকে প্রাপ্ত তথ্য এবং প্রতিক্রিয়ার ভিত্তিতে আমাদের অ্যাপটি উন্নত করার জন্য ক্রমাগত চেষ্টা করি);

7.2.4. পর্যায়ক্রমিক ইমেইল পাঠাতে;

7.2.5. একটি প্রতিযোগিতা, প্রচার, সমীক্ষা বা অন্যান্য অ্যাপ বৈশিষ্ট্য পরিচালনা করতে।

7.3. Jomma আপনার আর্থিক তথ্য অ্যাক্সেস করতে পারে - যেমন, কিন্তু সীমাবদ্ধ নয়, BO অ্যাকাউন্টের ব্যালেন্স, ধারণকৃত শেয়ার/বন্ড/মিউচুয়াল ফান্ড ইউনিটের মান এবং সংখ্যা, Jomma- অধিভুক্ত ব্রোকার/এএমসি এবং অন্যান্য আর্থিক সিকিউরিটিজের লাভ/ক্ষতি রিয়েল-টাইম ভিত্তিতে আপনার ভবিষ্যত বাণিজ্য অনুরোধগুলি যাচাই করার পাশাপাশি আপনার কাছে প্রাসঙ্গিক বিশ্লেষণাত্মক তথ্য গণনা ও প্রদর্শনের উদ্দেশ্যে ।

7.4. আমরা আপনার ব্যক্তিগত তথ্য ধারণ ও সংরক্ষণের নিরাপত্তা বজায় রাখার জন্য বিভিন্ন ধরনের নিরাপত্তা ব্যবস্থা বাস্তবায়ন করি। যাইহোক, আমরা বা কোন তৃতীয় পক্ষ আপনার ব্যক্তিগত তথ্য সংরক্ষণের সাথে সম্পর্কিত নিরাপত্তা এবং নিরাপত্তা ব্যবস্থার জন্য কোন ওয়ারেন্টি বা গ্যারান্টি প্রদান করি না।

8. মেধা সম্পত্তি অধিকার

8.1. সমস্ত কপিরাইট, ট্রেডমার্ক, পেটেন্ট, ব্র্যান্ড নাম, কর্পোরেট নাম এবং অন্যান্য বুদ্ধিবৃত্তিক সম্পত্তি অধিকার কোন উপাদান বা বিষয়বস্তু (সীমাবদ্ধতা ছাড়াই সফ্টওয়্যার, ডেটা, অ্যাপ্লিকেশন, তথ্য, পাঠ্য, ফটোগ্রাফ, সঙ্গীত, শব্দ, ভিডিও, গ্রাফিক্স, লোগো, প্রতীক, আর্টওয়ার্ক, ডিজাইন, লেআউট, চেহারা এবং অন্যান্য উপাদান বা চলমান ছবি) পরিষেবাগুলির মধ্যে থাকা বা অ্যাক্সেসযোগ্য যা হয় Jomma-এর মালিকানাধীন বা পরিষেবাগুলির অংশ হিসাবে ব্যবহারের জন্য অধিকারের মালিক(দের) দ্বারা Jomma-এর লাইসেন্স দেওয়া হয়েছে এবং /অথবা অ্যাপে। Jomma-এর নাম এবং লোগো হল Jomma-এর নিবন্ধিত ট্রেডমার্ক। এখানে পুনরুত্পাদিত সমস্ত ট্রেডমার্ক, যা Jomma-এর সম্পত্তি বা লাইসেন্সপ্রাপ্ত নয়, তাদের নিজ নিজ মালিকের সম্পত্তি।

8.2. আপনি শুধুমাত্র এই শর্তাবলীতে সেট করা অ্যাপ এবং/অথবা পরিষেবাগুলি অ্যাক্সেস/ব্যবহার করতে পারবেন। আপনি যদি অ্যাপে পর্যালোচনা করা ছাড়া অন্য কোনো উদ্দেশ্যে বিষয়বস্তু বা এর কোনো অংশ অ্যাক্সেস/ব্যবহার করতে চান তাহলে আপনাকে সেই উপাদানের অধিকারের মালিকের পূর্বে লিখিত অনুমতি নিতে হবে। সমস্ত অধিকার স্পষ্টভাবে সংরক্ষিত।

8.3. উপরোক্ত উল্লেখ করার পর আপনি কোন বিষয়বস্তুর (সম্পূর্ণ বা আংশিক) বিষয়ে যোগ্য হবেন না:

8.3.1. পুনরুত্পাদন, সদৃশ, অনুলিপি, বিক্রয়, বাণিজ্য বা পুনঃবিক্রয় কোন উদ্দেশ্যে বিষয়বস্তুর কোনো অংশ; বা

8.3.2. বিষয়বস্তুর কোনো অংশ তৃতীয় পক্ষের কাছে প্রেরণ করা বা তৃতীয় পক্ষকে যে কোনো উদ্দেশ্যে কোনো অংশে প্রবেশ/ব্যবহার করার অনুমতি দেওয়া, যদি না স্পষ্টভাবে অনুমতি দেওয়া হয়; বা

8.3.3. বিষয়বস্তুর যেকোনো অংশ পরিবর্তন, সম্পাদনা, সংশোধন বা পুনর্বিন্যাস।

8.4. এই অ্যাপ, পরিষেবা এবং/অথবা বিষয়বস্তুর যেকোনো অননুমোদিত অ্যাক্সেস/ব্যবহার ক্ষতি, জরিমানা, ক্ষতি, আইনি মামলা এবং/অথবা ফৌজদারি অপরাধের দাবির জন্ম দিতে পারে। এছাড়াও, এই অ্যাপ, পরিষেবা এবং/অথবা বিষয়বস্তুর আপনার অননুমোদিত অ্যাক্সেস/ব্যবহারের ফলে শুরু হওয়া যেকোনো দাবি, চাহিদা, জরিমানা, কার্যধারা বা আইনি মামলা (দেওয়ানি বা ফৌজদারি) থেকে উদ্ভূত সমস্ত খরচ এবং ফলাফলের জন্য আপনি দায়বদ্ধ থাকবেন।

8.5. Jomma-এর নাম, লোগো এবং/অথবা এর যেকোনো উপাদানের অননুমোদিত ব্যবহার, পুনরুৎপাদন বা পরিবর্তন কঠোরভাবে নিষিদ্ধ এবং Jomma এই ধরনের অননুমোদিত ব্যবহার, পুনরুৎপাদন বা পরিবর্তনের বিরুদ্ধে দাবি, আইনি প্রক্রিয়া আনতে এবং এই ধরনের ব্যক্তি বা সংস্থার শাস্তি, বিচার এবং ক্ষতিপূরণ এবং খরচ চাওয়ার প্রচেষ্টা সমস্ত সম্পদ ব্যবহার করবে।

9. কোনো ওয়ারেন্টি নেই

9.1. এখানে প্রদত্ত কোন তথ্য বা উপকরণ শুধুমাত্র আপনার ব্যক্তিগত তথ্য এবং সুবিধার জন্য, এবং কোন বাণিজ্যিক ব্যবহারের উদ্দেশ্যে নয় বা আপনার বিনিয়োগের সিদ্ধান্ত নেওয়ার জন্য নির্ভর করা হবে না এবং তাই একই ভাবে প্রতিনিধিত্ব বা কোনো ধরনের প্রস্তাব হিসাবে গণ্য করা হবে না। এই ধরনের তথ্য বা উপকরণগুলি একটি লেনদেন বা বাণিজ্য পরিচালনা করার সিদ্ধান্ত নেওয়ার উদ্দেশ্যে উপযুক্ত নয়, বা এটি বিনিয়োগ সংক্রান্ত পরামর্শ (বিনিয়োগ, ট্যাক্স, আইনি) প্রদান করে না বা বিশেষ আর্থিক উপকরণ সংক্রান্ত কোনো সুপারিশ, বিনিয়োগ, পণ্য বা পরিষেবা প্রদান করে না।

9.2. এই অ্যাপে থাকা তথ্য, পরিষেবা এবং/অথবা বিষয়বস্তু পুরানো হতে পারে এবং/অথবা অন্যান্য ত্রুটি বা বাদ থাকতে পারে। Jomma অ্যাপে যেমন আছে পরিষেবা এবং বিষয়বস্তু প্রদান করে এবং পরিষেবা এবং/অথবা বিষয়বস্তু (যার সন্তোষজনক গুণমান, ভাইরাস থেকে মুক্তি বা অন্যান্য বিষয়ে সীমাবদ্ধতা ছাড়াই সহ) কোনো প্রকারের কোনো ওয়ারেন্টি দেয় না, প্রকাশ বা উহ্য ক্ষতিকারক উপাদান, একটি নির্দিষ্ট উদ্দেশ্যে উপযুক্ততা, নির্ভরযোগ্যতা, সময়োপযোগীতা, নির্ভুলতা, সম্পূর্ণতা, নিরাপত্তা বা যে তারা ত্রুটি থেকে মুক্ত)।

9.3. Jomma বা কোন তৃতীয় পক্ষ কোনো বিশেষ উদ্দেশ্যে এই অ্যাপে পাওয়া, দেওয়া বা প্রতিনিধিত্ব করা হয়েছে এমন কিছুর কোন ওয়ারেন্টি বা গ্যারান্টি প্রদান করে না বা তথ্য বা উপকরণের সঠিকতা, সময়োপযোগীতা, কর্মক্ষমতা, সম্পূর্ণতা, উপযুক্ততা বা অন্যথায় (বিষয়বস্তু, পরিষেবা, কার্যকলাপ বা অফার সহ কিন্তু সীমাবদ্ধ নয়) হিসাবে কোন দায় বা দায়িত্ব গ্রহণ করে না । আপনি স্বীকার করেন যে এই ধরনের তথ্য, উপকরণ, বিষয়বস্তু, পরিষেবা, কার্যকলাপ বা অফারে ভুল বা ত্রুটি থাকতে পারে এবং আমরা আইন দ্বারা অনুমোদিত সম্পূর্ণ পরিমাণে এই ধরনের কোনো ভুল বা ত্রুটির জন্য স্পষ্টভাবে দায়বদ্ধতা বাদ দিই।

Jomma যেকোনো সময়ে পরিষেবা, বিষয়বস্তু, অ্যাপ এবং Jomma পরিষেবাগুলির সাথে সম্পর্কিত বৈশিষ্ট্য, সুবিধা এবং চার্জ এবং এই ধরনের বৈশিষ্ট্য, সুবিধা এবং চার্জ সম্পর্কিত তথ্য এবং উপকরণগুলি প্রতিস্থাপন বা সংশোধন করার অধিকার সংরক্ষণ করে প্রদত্ত সমস্ত Jomma পরিষেবাগুলি Jomma পরিষেবাগুলির জন্য স্ট্যান্ডার্ড শর্তাবলী সাপেক্ষে।

10. থার্ড-পার্টি হাইপারলিঙ্ক এবং অ্যাপ

10.1.সময়ে সময়ে, এই অ্যাপটি অন্যান্য অ্যাপের লিঙ্ক অন্তর্ভুক্ত করতে পারে। এই লিঙ্কগুলি আপনার সুবিধার জন্য এবং শুধুমাত্র আরও তথ্য প্রদানের জন্য প্রদান করা হয়েছে।

12. দায়

12.1. Jomma তার গ্রাহকদের সর্বোত্তম প্রচেষ্টার ভিত্তিতে ব্যক্তিগত অর্থ ও বিনিয়োগ সম্পর্কিত তথ্য এবং তথ্যের সঠিক সেট দিয়ে পরিবেশন করবে। যাইহোক, Jomma নির্ভরশীল তৃতীয় পক্ষের কাছ থেকে এই ডেটা এবং তথ্যের বেশিরভাগ উৎস করবে- তাই ডেটা-গুণমানের সমস্যা হতে পারে। সেক্ষেত্রে এই ধরনের অসম্ভাব্য পরিস্থিতিতে, পরবর্তী পরিণতির জন্য Jomma দায়ী থাকবে না।

12.2. আপনি স্বীকার করেন এবং অঙ্গীকার করেন যে আপনি সাইটের পরিষেবাগুলি অ্যাক্সেস করছেন এবং আপনার নিজের ঝুঁকিতে লেনদেন করছেন এবং সাইটের মাধ্যমে কোন লেনদেনে প্রবেশ করার আগে আপনার সর্বোত্তম এবং বিচক্ষণ রায় ব্যবহার করছেন। ব্রোকারেজ/এএমসি-এর কোনো ক্রিয়া বা নিষ্ক্রিয়তার জন্য বা ব্রোকারেজ/এএমসি-এর কোনো শর্ত, উপস্থাপনা বা ওয়ারেন্টি লঙ্ঘনের জন্য আমরা দায়বদ্ধ বা দায়ী থাকব না এবং এর দ্বারা স্পষ্টভাবে সেই বিষয়ে সমস্ত দায়িত্ব ও দায় অস্বীকার করব। আমরা আপনার এবং সংশ্লিষ্ট ব্রোকারেজ/এএমসিগুলোর মধ্যে কোনো বিরোধ বা মতানৈক্যের মধ্যস্থতা বা সমাধান করব না। আমরা আমাদের সাইটে তালিকাভুক্ত অন্য কোনো পরিষেবা প্রদানকারীর কোনো ক্রিয়া বা নিষ্ক্রিয়তার জন্য দায়বদ্ধ বা দায়ী থাকব না যা পেমেন্ট পরিষেবা প্রদানকারী ইত্যাদি অন্তর্ভুক্ত কিন্তু সীমাবদ্ধ নয়।

12.3. Jomma ব্যবহারকারীরা জ্ঞাতসারে বা অজ্ঞাতসারে তাদের লগইন তথ্য যেমন ব্যবহারকারীর নাম এবং পাসওয়ার্ড শেয়ার করলে Jomma দায়ী হতে পারে না।

12.4. ব্রোকার/এএমসি দ্বারা প্রকাশিত মূল্য তথ্যের নির্ভুলতার জন্য Jomma-কে দায়ী করা যাবে না। তালিকাভুক্ত শেয়ারের মূল্য গতিশীল হবে এবং বাজারের ট্রেডিং এর সময় পরিবর্তন সাপেক্ষে।

12.5. Jomma ব্যবহারকারীর সম্মতি অনুসরণ করে Jomma-অধিভুক্ত প্রতিষ্ঠান/অংশীদারগণ কীভাবে তাদের কাছে উপলব্ধ তথ্য ব্যবহার করে তার জন্য Jomma কোন দায়বদ্ধতা/আইনগত দায় বহন করতে পারে না।

12.6. Jomma ব্যবহার, অ্যাক্সেস, লাভ বা ডেটা বা কোনো প্রত্যক্ষ, পরোক্ষ, বিশেষ বা ফলস্বরূপ ক্ষতি বা ক্ষতির জন্য দায়বদ্ধ হবে না। এই ধরনের ক্ষতি বা ক্ষতি চুক্তি, অবহেলা, নির্যাতন বা অন্যথায় পূর্বোক্ত যেকোনো সীমাবদ্ধতা ছাড়াই উদ্ভূত হোক না কেন এর সাথে সম্পর্কিত ক্ষতি:

12.6.1. অ্যাপ, পরিষেবা এবং/অথবা বিষয়বস্তু ব্যবহারে আপনার ব্যবহার, নির্ভরতা বা অক্ষমতা;

12.6.2. আপনি যদি অসন্তুষ্ট হন বা আপনি অ্যাপ, পরিষেবা, বিষয়বস্তু এবং/অথবা এই শর্তাবলীর কোনও অংশের সাথে একমত না হন তবে আপনার একমাত্র প্রতিকার হল এই অ্যাপ, পরিষেবা এবং/অথবা বিষয়বস্তুর আপনার ব্যবহার/অ্যাক্সেস বন্ধ করা।

13. আপনার দ্বারা ক্ষতিপূরণ

13.1. ক্ষতিপূরণকারী পক্ষ হিসেবে উল্লেখ করা হয়েছে সম্পূর্ণরূপে বিরুদ্ধে এবং ক্ষতিপূরণকারী পক্ষগুলোকে সমস্ত ক্ষতি, দাবি, কার্যধারা, মামলার দাবিতে ক্ষতিমুক্ত রাখতে এবং খরচ (যুক্তিসঙ্গত আইনি খরচ সহ) এবং আপনার অ্যাপ, পরিষেবা এবং/অথবা ব্যবহার/অ্যাক্সেসের ফলে তৃতীয় পক্ষের দ্বারা কোনও দাবি কার্যধারা বা মামলার ফলে ক্ষতিপূরণকারী পক্ষগুলো যেভাবেই ব্যয় করে থাকুক না কেন দায়বদ্ধতা এই শর্তাবলী লঙ্ঘন বা অ পালন বিষয়বস্তু।

13.2. আমরা আপনাকে এমন কোনো দাবি, কার্যপ্রণালী বা মামলার বিষয়ে অবহিত করব যা আমরা বা অন্য কোনো ক্ষতিপূরণপ্রাপ্ত পক্ষগুলো পেয়েছি এবং আপনি এতদ্বারা আমাদের এবং/অথবা ক্ষতিপূরণপ্রাপ্ত পক্ষগুলোর যে কোনো দাবি রক্ষা বা নিষ্পত্তি করার সম্পূর্ণ ক্ষমতা প্রদান করতে সম্মত হন , কার্যপ্রণালী বা মামলা এবং আমাদের এবং/অথবা ক্ষতিপূরণপ্রাপ্ত পক্ষগুলোর যেকোনও যুক্তিসঙ্গত সহায়তা প্রদান করবে এই ধরনের দাবি, কার্যধারা বা মামলাগুলোকে রক্ষা করতে বা নিষ্পত্তি করার জন্য আপনার একমাত্র খরচে।

14. সাধারণ

14.1. এই অ্যাপের পৃষ্ঠাগুলিতে বিষয়বস্তু এবং পরিষেবাগুলির সাথে সম্পর্কিত তথ্য এবং উপকরণগুলি আপনার সাধারণ তথ্য এবং ব্যবহার/অ্যাক্সেসের জন্য এবং এই ধরনের তথ্য এবং উপকরণগুলোর যেকোনো অংশ আমাদের নিজস্ব বিবেচনার ভিত্তিতে বিজ্ঞপ্তি ছাড়াই পরিবর্তন সাপেক্ষ।

14.2. Jomma কোনো পূর্ব বিজ্ঞপ্তি ছাড়াই যেকোনো সময়ে পরিষেবা, বিষয়বস্তু, অ্যাপ, এর নীতি এবং/অথবা এই শর্তাবলী পর্যালোচনা, সংশোধন, সংশোধন এবং/অথবা পরিবর্তন করার অধিকার সংরক্ষণ করে এবং আপনি এই ধরনের সংশোধন দ্বারা আবদ্ধ বলে বিবেচিত হবেন সংশোধিত বা পরিবর্তিত অ্যাপ, পরিষেবা এবং/অথবা বিষয়বস্তু ব্যবহার/অ্যাক্সেস চালিয়ে যাওয়ার মাধ্যমে।

14.3. এই শর্তাবলীর নির্মাণ, বৈধতা এবং কার্য সম্পাদন বাংলাদেশের প্রচলিত আইন দ্বারা সকল ক্ষেত্রে নিয়ন্ত্রিত হবে। আপনার এই অ্যাপের ব্যবহার/অ্যাক্সেস এবং অ্যাপের এই ধরনের ব্যবহার/অ্যাক্সেসের ফলে উদ্ভূত যেকোনো বিবাদ বাংলাদেশের প্রচলিত আইনের অধীন।

14.4. যদি এই শর্তাবলীর বিধানের কোন অংশ কোন বিচার বিভাগীয় বা অন্য উপযুক্ত কর্তৃপক্ষ দ্বারা বাতিল, বাতিলযোগ্য, অবৈধ বা অন্যথায় অপ্রয়োগযোগ্য বলে ঘোষণা করা হয়, তাহলে এই ধরনের একটি মেয়াদ সংশোধন করা হবে যা Jomma-এর বিবেচনার ভিত্তিতে এই শর্তাবলী থেকে বিচ্ছিন্ন করা যেতে পারে। শর্তাবলী এবং প্রভাবিত বিধানের অবশিষ্ট অংশ এবং এই শর্তাবলীর অন্যান্য অবশিষ্ট বিধান পূর্ণ বল এবং কার্যকর থাকবে৷

14.5. যেখানে এই শর্তাবলী অন্যথায় প্রদান করে তা ছাড়া, এখানে থাকা অধিকার এবং প্রতিকারগুলো ক্রমবর্ধমান এবং আইন দ্বারা প্রদত্ত অধিকার এবং প্রতিকারগুলোর জন্য একচেটিয়া নয়৷ Jomma-এর ব্যর্থতা যে কোনো সময় বা যেকোনো সময়ের জন্য কোনো এক বা একাধিক নিয়ম ও শর্তাবলী প্রয়োগ করতে ব্যর্থ হলে তা পরবর্তীতে সব শর্ত ও শর্তাবলী প্রয়োগ করার জন্য তাদের বা অধিকার ছাড় দেওয়া হবে না।

14.6. Jomma এই শর্তগুলোর অধীনে তার কোন বাধ্যবাধকতা মেনে চলতে কোন বিলম্ব বা ব্যর্থতার জন্য দায়ী হবে না যদি বিলম্ব বা ব্যর্থতা এমন কোন কারণে ঘটে যা আমাদের যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরে। এই অবস্থা তোমার সংবিধিবদ্ধ অধিকারকে প্রভাবিত করবে না।

14.7. আপনি তৃতীয় পক্ষকে এই শর্তাবলী বরাদ্দ করবেন না। Jomma এই শর্তাবলী সম্পূর্ণ বা আংশিকভাবে কোন তৃতীয় পক্ষকে তার বিবেচনার ভিত্তিতে বরাদ্দ করতে পারে।

14.8. আপনি স্বীকার করেন যে এই শর্তাবলীর সাথে সম্মত হওয়ার ক্ষেত্রে আপনি নির্ভর করেন না কোন ব্যক্তির (তা এইগুলির কোন পক্ষই হোক না কেন) কোন বিবৃতি, প্রতিনিধিত্ব, ওয়ারেন্টি, গ্যারান্টি বা বোঝাপড়ার (যথা অবহেলা বা নির্দোষভাবে করা হয়েছে) উপর, এ সম্পর্কে কোন প্রতিকার থাকবে না যদি না একটি ওয়ারেন্টি হিসাবে এই শর্তাবলীতে স্পষ্টভাবে উল্লেখ করা থাকে।

14.9. যদি আমরা পরিষেবা, বিষয়বস্তু এবং/অথবা অ্যাপকে স্থায়ীভাবে প্রত্যাহার করার সিদ্ধান্ত নিই, তাহলে এই ধরনের স্থগিতাদেশ, পরিবর্তন বা সমাপ্তির ফলে আপনার পরবর্তী কোনো ক্ষতি বা ক্ষতির জন্য Jomma আপনার কাছে দায়বদ্ধ থাকবে না। সমাপ্তি যাইহোক আমাদের প্রতি আপনার অর্জিত দায়গুলিকে প্রভাবিত করবে না।

15. গোপনীয়তা নীতি

15.1. Jomma গ্রাহকের ব্যক্তিগত তথ্য এবং আর্থিক তথ্যের গোপনীয়তা কঠোরভাবে বজায় রাখবে। সংশ্লিষ্ট গ্রাহকের কাছ থেকে নেওয়া সুস্পষ্ট সম্মতি ছাড়া এই জাতীয় কোন ব্যক্তিগত তথ্য এবং আর্থিক ডেটা কোন বহিরাগত পক্ষের সাথে ভাগ করা হবে না। ম্যানেজমেন্ট কর্মকর্তাদের গ্রাহক ডেটার অ্যাক্সেস গ্রাহকের মনোনীত সমস্যা/অনুরোধের পরিষেবা দেওয়ার জন্য প্রয়োজনীয় পরিমাণে সীমাবদ্ধ থাকবে।

15.4. Jomma-এর গ্রাহকদের কোন ব্যক্তিগত নথি যেমন ছবি, NID বা TIN ইত্যাদি কোন অননুমোদিত বহিরাগত পক্ষের সাথে শেয়ার করা হবে না। এই ধরনের নথিগুলি শুধুমাত্র তখনই শেয়ার করা হবে যখন এটি গ্রাহকদের দ্বারা Jomma-কে অর্পিত কাজের জন্য প্রয়োজনীয়।

16. বৈষম্যহীন নীতি

Jomma এবং তার সহযোগীরা জাতি, ধর্ম, জাতীয় উৎস, অক্ষমতা, লিঙ্গ, বৈবাহিক অবস্থা, লিঙ্গ পরিচয়, বয়স বা প্রযোজ্য আইনের অধীনে সুরক্ষিত অন্য কোন বৈশিষ্ট্যের ভিত্তিতে ব্যবহারকারীদের বিরুদ্ধে বৈষম্য নিষিদ্ধ করে।

17. সরকারি আইন

শর্তাবলী গণপ্রজাতন্ত্রী বাংলাদেশের আইন অনুসারে বোঝানো হবে। আপনি সম্মত হন যে ঢাকা, বাংলাদেশে অবস্থিত আদালত, ট্রাইব্যুনাল এবং/অথবা আধা-বিচারিক সংস্থাগুলোর এই চুক্তির অধীনে বাংলাদেশের অভ্যন্তরে উদ্ভূত যে কোনও বিরোধের একচেটিয়া এখতিয়ার থাকবে৷

18. ট্রানজিটে ওয়েব-সাইট এবং ডেটার উপলব্ধতা

আমরা ওয়ারেন্টি দিব না যে সাইটটি সর্বদা চলমান থাকবে এবং সেই অ্যাক্সেস ব্যাহত হবে না, ব্যর্থতা, ত্রুটি বা বাদ দেওয়া বা সংক্রমণের সময় তথ্যের ক্ষতি হবে না। আমরা এও ওয়ারেন্টি দিই না যে কোনো ভাইরাস বা অন্যান্য দূষিত ডেটা প্রেরণ করা হবে না বা আপনার কম্পিউটার সিস্টেমে কোনো ক্ষতি হবে না। আপনার সিস্টেম এবং ডেটার পর্যাপ্ত সুরক্ষা এবং ব্যাক আপের জন্য আপনি সম্পূর্ণরূপে দায়ী থাকবেন। সাইটের সাথে সংযোগে ব্যবহার করা যেতে পারে এমন কোন তৃতীয় পক্ষের সফটওয়্যার-এর কার্যকারিতা বা কার্যকারিতা সম্পর্কে আমরা কোনও প্রতিনিধিত্ব বা ওয়ারেন্টি করি না।
